I don't want to defend the current state of American justice, particularly in the light of the things that you mention - Guantanamo, Abu Ghraib, and secret detention centers. These things are grave injustices, and we (U.S. citizens) have an obligation to oppose them and try to end them, if we are able.

At the same time, your comments are based on an absolute vision of the "independence" of the judiciary. Probably, such pure independence doesn't exist. Our system has, at best, had partial independence. Right now, even that partial independence is diminished.

However, to simply give in to complete cynicism and state that it is better to completely dismiss "justice for all" as an empty slogan would be a mistake. If that were the approach one should take, then why bother opposing the abuses or fighting for as much independence as possible for the judiciary?

I once studied law: a few courses, general and specialized. In EACH course, as I was always asking questions and commenting that: "Well, that's no justice"...
