Well, I cannot comment on any other country but my own - India, which is deeply into piracy.

I do not defend this illegal practice at all, but a wise analysis will reveal that there are two sides to this piracy story.

India though is rapidly emerging as a land of economic opportunities with economic status of majority of its people improving tremendously, however, we cannot overlook the fact that it is also a land of maximum number of poor people in the world. (India is afterall a land of one sixth of world's population!)

The 'class' spectrum in India is wide. Many of its otherwise educated and "user" "middle-class" population cannot "afford" expensive softwares. So they resort to buying much cheaper pirated versions which run as hassle-free as originals.

Now, the bright side to it is that because of piracy, educated "middle-class" Indians are also able to use computers and contribute to things achieved through their usage and also able to connect to the world through the Net as consumers and contribute massively to success of online transactions worldwide.

Use Linux and other open-source software, and you instantly become stranger to all this "software piracy" thing. This too might cause loss to the US software business, but it causes gains to all other countries' software business, where local technicians can administer, install and improve the said software.

As for "media piracy", well, if some extravagantly rich artists and producers are less extravagantly rich, and only very rich, I'll not cry over their fate.

There is no winnable fight against technology. Internet, peer-to-peer, downloads and friends are here to stay.

Let's see. You can buy a LEGAL copy of Vista in Thailand or China for around $5, but in the U.S. it will cost you well over $300. It's rather like prescription drugs. U.S. made pharmaceutical drugs are sold all over Europe for about 10% of what they sell for here. So long as major corporations steal from and defraud and otherwise cheat consumers and the countries that host them, fix prices, and engage in all manner of predatory business practices, they have no right to complain about "piracy". If we had any brains, we wouldn't extend the "global" version any protections whatsoever, including patient and other trade protections. There are a lot of big problems with piracy, and they go straight to the hardware we use. Music, movies, and even games are based on very versatile, some might say liquid media. As MP3 sellers go, when you buy the song, all you receive is a file. An easily reproduced file.

As I see it, many people have taken advantage of the easy format to not pay for their goods. This happens in the US as well as abroad and is a widespread problem. And it really is a problem in the purest sense of the word, not some philosophical question of ownership. What is made by a band in Iowa is then produced and distributed all around the world by one large company whose task it is to make money on these transactions. Since digital media is so much cheaper, it has become better for both producer and consumer to simply move those files in their most liquid varieties. But replication and reuse of those files is, of course, theft.

Then again, so is taking a pen from work. So the idea inherent here is whether taking one song off one CD is justifiable theft and then what to make of the underground outfits literally turning out constant replicas of movies and music as fast as they possibly can for resale. It is probably the latter that causes much more damage.

I am not immune to that difference. There has to come a point where you must respect the artist and the company that records and distributes their music. But if a CD is terrible save for one song, then is it justifiable to just take that one? At what point does one draw the line between inconsequential theft and malignant theft?

I think that is the philosophical question. The company and artist obviously poured an awful lot of time and effort into the creation and distribution of these files for which pirates pay nothing. That is absolutely theft. The question is: how guilty are you?

Industrialization owes heavily to the cheap raw materials snatched out of the undeveloped countries of Africa, Asia and S. America, often by total disregard for life and welfare of the locals. If people of those countries feel no obligation to pay for the fruits of this process, it is because it is considered fare game; a payback.

In my opinion, after having observed the very rapid progress of technology, particularly in the last decade, it should be impossible to refrain fraud of various nature. If it costs american companies $.58 billion, the figure will be much more important if you take into consideration the fraud all over the world.
We have seen that laws have not helped to really eliminate fraud and dishonest propositons made on the internet and to which millions of naive people are taken in by their greediness to make hefty 'profits' rapidly. The world is made of two kind of people, the clever and the pigeons. The clever are also made of two kinds, the honest and dishonest. For the latter there will always be pigeons.

The talk of 82 billion dollar loss is one side of story but at the same moment it should also be mentioned that how much profit has been earned by software giants. Is it not tre that the software companies are asking an unrealistic price of their product

The countries who are developing the software and tech books also manufacturing and selling those machines which are making fast mirror images of these softwares . Their is no restriction for exporting those machines. They are developing those systems which can down load the complete hard disk of any computer discreetly and save it at any part of the world.

Blaming crackers easy but once a software which is costing hundreds of dollar will be available for a single dollar then their will be a temptation for piracy.

Pressurising the thirld world countries may result some televised images of burning the CDs or arresting and closing some shops but will never solve the problem.

For a permanant solution the softwares should be made cheaper. the companies like Microsoft should allow multi users like colleges to pay one time fees for all their students. The industries should pay also one time fees which is affordable. Young students may get a part of the software free dowloaded which will solve their basic needs and help in learning the process. On later stage full version may be purchased .

If the software companies will be ready to share their cake then it will be a win win situation for all parties .

This is one of the most profound philosophical questions of all. Inventors invent and then people imitate always ahead of the path of invention in some sort of natural progression thus "stifling" innovation and making the inventor exasperated and wanting to throw his inventions to the wind.

The question it seems to me is one of somehow keeping innovation ahead of people's natural desire to imitate. Placing laws to curb imitation is not enough or even natural. Imitation is the natural desire to "spread" and is more difficult to rein in than a disease. Imitation is also valuable and should be considered as one of the most profound group behaviors possible.

But understandably we value originality more. The question is why we are not more aware how new the concept of the original is in human life and how difficult it is to keep it ahead of the desire to imitate. In fact the capability of the original has only accidently so far moved ahead of the desire to imitate in human life--we have not reliably made moves toward the original.

My belief is that the problem cannot be solved unless we have the capability to innovate moving ahead of the easy capacity to imitate. But that of course is extremely difficult to put into practice. It means having not only increasing amounts of innovators in society, it means each generation of innovators truly can surpass the previous. The question is not one of laws against imitation but practices toward increasing numbers of innovators. Copyright so far stands somewhere in the middle and does not clearly articulate a past, present and future--a direction.

To say it again, this is one of the most profound questions possible. So many sciences and arts must come together in a person's mind to see the problem clearly. I offer only a few words on the problem. But a few more words: with our increased technology today we seem to be facilitating the desire--the capability--to imitate more than the capacity to innovate. And the capacity to innovate often does require the spread of ideas first (to bring up a complication of the problem).

I think the problem should be handled by increasing the capacity to imitate to the extreme and then building on this foundation a profound move toward increasing creators--move in both the directions of imitation and creation in other words. So far we seem to want to limit imitation and not really ask how we can get innovators at all.

The problem must be seen in the widest sense. Hope that is a satisfactory answer to the question.
